Terms of service

These terms govern access to ciakapp.com and use of the Ciak app. By creating an account or using the service, you agree to these terms and the Privacy policy.

Service provider

Ciak is provided by IMPROBABILItea S.R.L., with registered office at Corso Galileo Ferraris 162, 10134 Turin (TO), Italy, VAT number 13409210013. You can contact us at hello@ciakapp.com.

Eligibility

You must be at least 14 to create an account. If you are under 18, you confirm that you have permission from a parent or legal guardian where required. You must be able to enter into this agreement and comply with laws that apply where you use the service.

The service

Ciak lets you track films and shows, add ratings and takes, receive personalised recommendations, connect with friends and run shared evenings. We may introduce, change or remove features to improve the service, security or legal compliance.

During the beta, some features may be incomplete, change or be temporarily unavailable. We aim to provide a reliable service but don't guarantee uninterrupted availability, error-free operation or compatibility with every device.

Account and security

You are responsible for activity through your account and for protecting your device and access codes. You must provide accurate information, keep profile details up to date and email hello@ciakapp.com immediately if you suspect unauthorised access.

You may not sell, transfer or make your account available to someone else. You may let a guest join an evening through the dedicated feature without creating an account in their name.

Recommendations

Ciak ranks and recommends titles using primarily your selected services, viewing history, ▲/▼ ratings, reasons, preferences, available time, evening mood and, where relevant, participants' tastes. You can influence these parameters by changing or deleting the relevant data in the app.

Recommendations are suggestions, not guarantees of enjoyment, availability or suitability. The final choice is yours. Availability, prices, ratings and title information may change and should be checked with the platform distributing the content.

Friends, invitations and evenings

You can connect with others through codes and requests. Ratings, library and activity are shared only through available settings. You are responsible for inviting people you know and must not use codes, notifications or search to harass, spam or collect information about other users.

If you enter the name and preferences of a guest without an account, you confirm that you have informed them and have their permission. Participants remain free to leave an evening or change their sharing settings.

Content you publish

You keep ownership of takes and other content you create. When you publish content, you grant IMPROBABILItea a non-exclusive, royalty-free licence limited to storing, reproducing, displaying and distributing it within Ciak according to your chosen visibility. The licence ends when you delete the content, except for temporary technical copies or legal requirements.

You must have the rights needed to publish your content. Don't post anything unlawful, threatening, defamatory, discriminatory, obscene, fraudulent or harmful to privacy or intellectual property; personal data about others; advertising, spam, malware; or instructions for bypassing security. You must mark spoilers correctly.

Reports and moderation

You can report a take in the app or email hello@ciakapp.com with the content, reason and information needed to locate it. We assess reports and may cover, restrict or remove content, reduce visibility, suspend features or accounts and cooperate with authorities where necessary.

Where required by law, we will tell the affected user about the measure and its main reasons. You can challenge a moderation decision at hello@ciakapp.com. Automated spoiler controls don't replace our assessment of illegal content or abuse.

Third-party services and content

Title information, artwork and availability may come from TMDB and JustWatch. Related trademarks and works belong to their respective owners. Ciak may link to streaming platforms or other third-party services with their own terms and policies. IMPROBABILItea does not control or sell their subscriptions and is not responsible for their content or availability.

The landing page is hosted on Cloudflare Pages, uses Pages Functions and Cloudflare D1 to manage the waiting list, and uses PostHog EU for analytics under the two-tier model described in the Privacy policy and Cookie policy. These suppliers operate under their own terms and, when processing data for us, under their applicable agreements with IMPROBABILItea.

Price

The beta is free. If we later introduce paid features or a subscription, we will show the price, term, renewal and applicable conditions before purchase. We won't charge you without your express confirmation through the App Store or another authorised channel.

Intellectual property

Ciak, its software, design, brand, original copy and service elements owned by IMPROBABILItea are protected by intellectual-property law. We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to use the service under these terms. You may not copy, modify, distribute, sell, decompile or exploit it except as the law permits.

Suspension and closure

You can stop using Ciak and request account closure at any time in the app, when available, or by emailing hello@ciakapp.com. We may restrict or suspend an account for a breach of these terms, a risk to users or infrastructure, a legal requirement or discontinuation of the service. Where possible, we will give you notice and a chance to export or delete your data.

Liability

Ciak is provided with the reasonable care expected of a digital service. To the extent permitted by law, we are not liable for interruptions outside our control, inaccurate third-party information, choices made from a recommendation, or indirect and unforeseeable losses. Nothing in these terms excludes liability that cannot lawfully be limited or mandatory consumer rights.

Changes to these terms

We may update these terms to reflect changes to the service, law or security. If changes are material, we will notify you before they take effect. Continued use after that date means you accept the updated terms; if you don't agree, you may close your account.

Governing law and disputes

These terms are governed by Italian law. If you are a consumer, mandatory protections in your country of residence and the court designated by applicable consumer law remain unaffected. Before starting a dispute, you can contact hello@ciakapp.com so we can try to resolve it.
